Photoshop is an ice/mixed route on the Bard-Harrington Wall in Lee Vining Canyon (Eastern Sierra, California).

One other thing - I notice that this pic is actually from Doug Nidever's Ice Report web site. I don't know if that would violate his copyright (if any) or not.

Doug doesn't mind! Asked him last week when we spoke at length at MMS as long as it used to promote Lee Vining Ice in a safe and conservative format. Informing folks of the fragile relationship that He has personally built with SC&E, the Landowner's of this area!

Copyright belongs to the photographer. See the summitpost FAQ and Terms of Use: this needs to be deleted unless Chief either took it or got the photographer's permission to use it.

(A person shown in a photograph will have privacy rights and some other rights to prevent certain uses of the photo (eg, expect a lawsuit if you use a photo to misleadingly imply that a celebrity endorses your product), but no copyright.)

So who was the photographer? That's whose permission you need. If you have permission to use a photo someone else took, you should say so in the caption so the elves don't delete it.
(Giving attribution to the source doesn't really make any difference in copyright law, though it's polite.)

Actually it was one of Doug's Guides and was shot with Doug's Service/Business camera. Therefore, Doug owns all the Rights.

I almost put in a parenthesis about employers being considered the "author" of "works made for hire", but didn't want to open that can of worms. It didn't occur to me that anyone could make enough money ice climbing to have employees taking photos of them "within the scope of their employment."
