permission?

"Credit" cuts no ice with the Copyright Act. Do you have Mr. Barton's / the MWO's permission to post this?

I believe I did everything properly, including sending them an email. I reposted this photo for two reasons: One, it is a beautiful shot. Two, I am an active member of the Observatory and this might help in a small way to advance thier nonprofit mission.

Oh, I suppose Mr. Barton assigned his rights to MWO for the usage described above via this form:

And I will say if Mr. Barton sees his photo on Summitpost, I will hope that he will be honored to have had his work reposted for more people to see. And what do you know... a search in google just now for "Luke Barton Boott Spur" brings up this very page as #1 on the list!

Indeed you did do everything right, thanks for clarifying. Because SP gets lots of contributions from folks who are not always diligent, it's best to include a phrase like "used by permission" in the caption, as suggested in SP's FAQ. If permission is from a license rather than personal, a link to the license is ideal.

Your point is a good one and well taken. Thank you. I'm a little hesitant about putting the "used by permission" on this one since I did not receive explicit permission. Their method only gives implicit permission. In my email to them, I did include the link to this page, so I would hope they would let me know if I needed any other verbiage.

The suggestion for adding "used by permission" is not to protect you against the MWO, it's to be sure that the Elves won't delete this page out of overzealousness.
I think by "implicit permission" you're referring to the issue with the MWO's photo submission form which I mentioned in a PM to you. I'll summarize for other readers: Based on the wording of the MWO's submission page, it's possible that the photographer didn't realize when he submitted the photo to the MWO that the MWO would be granting permission to other websites to make copies. (If that's true, then relying on permission from the MWO doesn't do us any good. The MWO can only pass on the rights it actually got from the photographer, and it can't get them without the photographer meaning to give them.) The best way to clear that up is to contact the photographer directly (not the MWO).

A wonderful picture!

The fiery color of the sunset and the red plants in the foreground, together with the mountains, make a great composition!
