Another Photo Taken

by Bill Reed » Fri Jan 13, 2017 2:48 pm

This time by a website: http://www.greatoutdoorshop.com
My photo: http://www.summitpost.org/along-the-pol ... 0/c-778627 Which I originally posted not long after joining SP but removed to edit and repost on a 2012 TR posting of a 2001 trip.

Came across it while searching for photos of an area I'm hoping to get to summer. While I realize that this kind of thing is only going to happen more and more, I'm wondering if or how often it has happened to other members and what to do about it. I sent them an e-mail via their "contact us" link on the website on Tuesday but have heard nothing so far.

Greatly appreciate hearing your thoughts/suggestions.
Thanks!!

I'm afraid it's happened to many of us, and neither is SP the only site from where people take pictures without permission. Simply stated, it's illegal to do that. But don't hold your breath waiting for the authorities to act: if nobody cries foul, nothing happens. Now, I'm no lawyer, but simply stated, if someone uses a picture without permission, you can claim compensation. How much compensation would be fair depends on how your picture has been used. You can first try to come to an agreement with the offender, but if that doesn't result in a satisfactory outcome, you can take your case to court. Whether that's worth it is hard to tell, but I guess it may only be the case if your picture is used commercially in one way or another. Ideally, a big company takes your picture and puts it center stage of a world wide marketing campaign - then you have a strong case for a fair amount of money, and, realizing their mistake, they'll be happy to settle quickly to avoid getting a bad press about it.

Anyway, if you want to make work of it, this is a useful article, be it just to stop your picture being used or for further steps. When I found some of my own pictures appearing on other sites, I sent out a few e-mails. Usually got an apology back, sometimes nothing.

____
On a related matter: some SummitPost members also occasionally post pictures that they didn't take themselves and for which they don't have permission. If nobody notices it, well, nothing happens of course. If someone does, then the elves do their best to find out if there is indeed a copyright infringement. If so, the image will be deleted. As it happens, there is just such a case in progress with this User Profile Image. I posted a comment the other day, asking for explanation. I'm waiting for a response, and I'll take it from there.
