More thievery / copyright infringement

by Alpinist » Mon Aug 22, 2011 7:57 pm

Alert: This website is stealing content from SummitPost. They stole the description word for word from at least a dozen of my mountain pages.

For example, compare my Pluto Dome page with theirs.

They stole the content for several (maybe all) of my other Sierra mountain pages. (You'd best check to see if they stole any of your pages.) Here's a list of all their peaks just in Yosemite. I'm guessing they stole all of them from SP.

Does SP have an attorney? This requires more than just one member sending them en email...

On a related note, the Terms of Service page on SP states nothing about our copyrights. The language seems focused exclusively on the prohibition of members uploading copyright materials to SP. Language should be added to that page to help protect our copyrights, at a minimium, such as:

"No material or content may be reproduced from this website without the express written authorization of its owner."

Did you try the "contact us" on that page?
http://www.ohranger.com/info/contact-us

it could be that the person who hires the writers doesn't know.

I can draft a letter from the site administration, but it would be more effective if I had a compilation of material copied from more than one member. So far, I have found nothing of mine on the site, but I've only had a quick look at the Glacier material for now.

Hopefully, others can report here if their material has been copied.

I can also update the TOS to address copying members' material, but if it's too broadly worded, it could technically bar people from, say, copying someone's route diagram to a computer to study while on a trip, something it's my understanding the site owners wanted people to be able to do.

Any suggestions for how to word this properly will be welcome.

Here is a starter:

"No material or content may be reproduced from this website and used on other websites, or for personal or financial gain, without the express written authorization of its owner."

Perhaps we can start tweaking from there. I'd like to see something simple and clear but thorough, not hopelessly entangled in legalese.

Here is a list of peaks that they stole from me.

Bigelow Peak
Chittenden Peak
Craig Peak
Forsyth Peak
Haystack Peak
Keyes Peak
Pluto Dome
Quartzite Peak
Saurian Crest
Schofield Peak
Snow Peak
Wells Peak

Note: downloading material for personal use or research is not the same as reproducing it.

As long as you keep the attorneys and contract people off it you should be fine :)

It's a bizarre site. They have the "Belmont Courthouse" mislocated by at least 100 miles; the Nevada points of interest mainly consist of odd, bizarre places. This site was built by contractors.

His webmaster seems to have forgotten to point the thumbnails at the correct places!

Isn't that the guy with the TV adventure show?

It is quite bizarre, he wants to maintain an image as an 'adventurer' or something similar. He was saying that he is sponsored to do a month worth of outings which he called "summit a day(although in his schedule rainier and shasta all took 4!)." Included was the Sierra Challenge, doesn't seem like he actually participated.
I do not think that TV show is actually running on television.

The TOS and FAQ have been updated to codify that members' material is copyrighted and may not be used without their permission.

An email will be going to the website, if not today, then tomorrow. Alpinist, did you send your own email already?
